§1 Definition and Contract Partners

(1) The following terms and conditions apply to any contracts concluded via the online store www.josianebiwer.com.

(2) All orders and offers, placed online on www.josianebiwer.com, are based on the following terms and conditions, as they are at the current state and were not modified in accord with Josiane Biwer.

Our offers and orders are only concluded with final customers for private use.

(3) Josiane Biwer is a Luxembourgish company and therefore is governed by the Luxembourgish law. Should there be any complaints, we were not able to resolve otherwise, you can initiate a proceeding against Josiane Biwer in that case before the competent courts of Luxembourg.

§3 Contract Formation

(1) The display of our goods in our online shop has the only purpose to show the customer our line of goods. It is under no condition a binding contract.

(2) Only after clicking on the button [verbindlich kaufen/checkout], a binding offer is placed by you, as customer.

(3) After receiving your binding offer, we send you an automatic e-mail, which is considered as a confirmation of reception. This e-mail is however no confirmation of acceptance of the contract. Under rare circumstances, we might not be able to carry your order into execution. In this case, you will be immediately informed.

(4) As a next step you will receive an e-mail with the confirmation of acceptance of the contract.

(5) All documents of the contract are provided to you in English and German.

(6) Your order will be saved in our database. You are welcome to contact us at any time to get a copy.

§4 Price

All prices are in EURO and include VAT. Shipping costs are not included. For more information about Shipping costs, please read §7 of these terms and conditions.

§5 Payment

(1) All payment options are generated by Paypal to guarantee you a safe pay.

(2) While paying with paypal, you will be redirected to the website of Paypal. To execute the payment via paypal, you are not obliged to have a Paypal account or register. Paypal legitimates your data information and verifies the correct transaction for us.
After finishing your order, we inform Paypal to transfer the payment transaction to our account. More details will be delivered to you, during the process of order, or on the website of Paypal.

§6 Delivery and rights of property

(1) All orders will be shipped to the address in Europe, you stated while placing your order unless another agreement was accepted by Josiane Biwer. 

(2) Orders are only accepted in a normal, private amount.

(3) All items stay property of Josiane Biwer until complete payment.

(4) The delivery time is 1 week. As soon as your order is completed, you will receive an e-mail containing the details of the shipment.

§7 delivery costs

All deliveries are executed by Post Luxembourg. In the following you can find a list of the different delivery costs per country:

If you nevertheless decide to purchase an item and do not have a delivery address in Europe, you must organise delivery and collection yourself.

Any additional costs in the form of any import sales tax and customs duties incurred on dispatch shall be borne by the customer.

§8 Withdrawal

According to Luxembourgish regulations concerning online shopping, the customer has the right to withdraw his contract without any explanations in a period of 14 consecutive days after the conclusion.
To claim your right of withdrawal, you have to send Josiane Biwer an unequivocal statement (e.g. letter sent by mail or email) to Josiane Biwer, 44, Haaptstrooss, L-6869 Wecker Luxemburg or to info@josianebiwer.com
You may use the cancellation form, in attachment to these terms and conditions, albeit it is not obligatory.
To respect the deadline of withdrawal, it is sufficient to prove the unequivocal statement was send during the deadline.

The right of withdrawal isn't applicable for goods, that were specially customized for you and deviate from our standard goods.

Conditions of return

All goods need to be in clean and unworn condition. Please make sure to not wear excessively make up or transfer odors (perfume, sweat, cigarette steam etc) on to the items while the fitting. The product labels need to be attached and the items should be resend in their original packaging. Should one of these conditions not be completed, Josiane Biwer has the right to refuse the return and may claim costs for dry-cleaning.

Please contact us, before you return the package to us so that we can ensure the correct reception.

As soon as we receive your return order in our office, we will check the items in regard of the previous mentioned points and you will receive an e-mail confirming the receipt. Afterwards Josiane Biwer will refund the purchase money of the returned items.
The refund will be transferred to the same account, you specified previously in your order.

The costs for the return delivery are paid by the customer. We ask you to box the items safely and make sure the package will be shipped properly.
Josiane Biwer is not responsible for missing return orders or not properly shipped packages.

§9 Return and exchange

In case, you want to change your order to another size, color or you want to exchange it with another item, please contact us within 14 consecutive days after receiving your order and follow the guidance how to place a withdrawal and you will be refunded. To simplify the process, place a new order with your wishes.

§10 Privacy Policy

(1) Josiane Biwer takes meticulous care of the data you provide us during the process of visiting or buying on our website. As technology and future developments of our website change continuously, we recommend you to read the privacy police (see also the separate section "Privacy police" for further details) regularly.

(2) Josiane Biwer acknowledges and respects the laws about data protection, as far as they are applicable for the company. Josiane Biwer supports all your requests to obtain information according to section 13 and 14 and all notes according to the sections 15-22 and section 34, having as subject the data processing. All information will be delivered in  a precise, transparent, comprehensive and easy accessible way.

(3) When you request access to your personal data, Josiane Biwer will comply immediately, but not later than 1 month after the reception of your request. Due to some reasons, there might be a delay up to 2 months. Should there be any reason for a delay, Josiane Biwer is supposed to inform you within 1 month about an extension, explaining the reason for a delay.

(4) Josiane Biwer collects personal data from you to carry into execution your order and the delivery of that order. Furthermore we use the personal data information to form a legal basis of the contract between Josiane Biwer and you as customer.

(5) We safe your personal data for the duration of our warranty period, given on our items and for the duration law requests the storage of contracts.

§10 Warranty

Transport damage

When receiving the packaging, the customer should check for possible damages and pronounce them to the transport company, as they can record the damage in writing. This step is not strictly necessary for you, as customer, to maintain your statutory rights. However it helps Josiane Biwer to claim the damage against the transport company. If you took pictures of the damage, please send them in a mail to info@josianebiwer.com.

Defective items

Josiane Biwer does her utmost to deliver high qualitative and perfect products. Should there, despite our high standard controls, be any problems with our products, please contact us and we will find the best solution for you.

§11 Copyright

All content and works published on Josiane Biwers website are governed by the copyright laws of Luxembourg. Any duplication, processing, distribution or any form of utilisation beyond the scope of copyright law needs the prior written consent of the author or authors in question.
